These General Terms and Conditions govern the purchase and use of software, digital products, license keys, utilities, tweaks, macros, and other digital content from TARF Tweaks.

The provider is leoworks, sole proprietor Sven Radtke, Bachstraße 96, 22083 Hamburg, Germany. TARF Tweaks is a product of leoworks.

1. Formation of Contract and Payment

The products displayed on the website do not yet constitute a binding contractual offer. By completing the order process, the customer submits a binding offer to purchase the selected product. The contract is formed upon confirmation of the order or upon provision of the product or license access.

Payment is processed in particular via Stripe. The customer is obligated to use only payment methods they are authorized to use.

2. Digital Delivery

All TARF Tweaks products are delivered digitally. Delivery may occur via a download, a license key, an account activation, or access within the TARF Tweaks software.

Under Section 327b of the German Civil Code (BGB), digital content is generally deemed delivered as soon as the content, or a suitable means of accessing or downloading it, has been made available to the customer. TARF Tweaks may technically document the time of delivery and activation.

3. License and Key Sharing

Upon purchase, the customer receives a personal, limited, non-exclusive, and non-transferable right of use in accordance with the respective product description.

Sharing, selling, passing on, or publicly disclosing license keys is not permitted. Equally prohibited are account sharing, unauthorized redistribution of the software, cracking, manipulation of the licensing system, circumvention of authentication, unauthorized disclosure of internal files, and unauthorized access to TARF Tweaks systems.

TARF Tweaks may suspend licenses, to the extent legally permissible, in cases of proven key sharing, payment fraud, manipulation, attacks on the infrastructure, or other significant abuse.

4. Proprietary Authentication and License System

TARF Tweaks uses its own authentication and licensing system. This system may record when a license was created, activated, used, or bound to a device.

This may involve processing and storing, among other things, the license ID, license key, activation status, time of first use, HWID or other device identifiers, IP address, Discord account ID, the linked Discord account (if applicable), login and authentication information, software version, system information, and security-relevant events.

This information serves in particular for license management, prevention of key sharing, fraud prevention, security, support, and evidence of whether and when a digital product was activated or used.

5. Withdrawal and Refunds

A. Statutory Right of Withdrawal

For consumers, the statutory provisions on the right of withdrawal generally apply.

B. Early Expiry for Immediately Supplied Digital Content

For digital content, the right of withdrawal may lapse before the regular withdrawal period expires if the customer expressly consents to TARF Tweaks beginning performance of the contract before the withdrawal period ends by immediately providing the digital content or license access, the customer confirms their awareness that their right of withdrawal thereby expires once performance of the contract begins, TARF Tweaks begins performance of the contract, and the customer receives the confirmation of the contract required for this.

Performance of the contract is deemed to begin at the moment TARF Tweaks provides the customer with the license key or access to the digital content.

C. Voluntary Refund Policy

TARF Tweaks generally does not provide voluntary refunds, returns, exchanges, or cancellations for digital products. This does not affect any statutory right of withdrawal that has not yet expired or any mandatory statutory rights relating to defective or non-delivered digital products.

In particular, no voluntary refund is available solely because of a change of mind, non-use, mistaken performance expectations, a change of hardware, or an accidentally selected product.

Activation, redemption, device binding, and first use of a license key may still be logged via TARF Tweaks' own authentication and licensing system for licensing, security, support, and evidentiary purposes. This is not, however, a requirement for the statutory right of withdrawal to expire under B.

D. Mandatory Statutory Rights for Defective or Non-Delivered Products

Mandatory statutory rights in the case of a digital product that is actually defective or was not delivered remain unaffected. The German Civil Code (BGB) provides, among other things, for subsequent performance in the case of defective digital products, and, under certain conditions, for a price reduction or termination of the contract.

6. Performance and System Changes

TARF Tweaks software may change settings of Windows and other system components. This may include registry settings, system services, and network, graphics, driver, power, and performance settings.

The effects of such changes depend on the respective computer, hardware, Windows version, drivers, BIOS configuration, installed software, and other circumstances. TARF Tweaks therefore does not guarantee any specific increase in FPS, reduction in ping, reduction in input lag, or other concrete performance improvement, unless this has been expressly agreed as a guaranteed product feature.

The user is responsible for backing up important files, following the instructions provided, and creating a system restore point where appropriate.

7. Blue Screens, System Issues, and Damages

To the extent legally permissible, TARF Tweaks assumes no liability for damages or issues caused by improper use, failure to follow instructions, unsupported modifications, incompatible third-party software, pre-existing system issues, or changes made by the user.

This may in particular concern blue screens, system instability, data loss, software conflicts, driver issues, network issues, or performance degradation.

A complete disclaimer of liability would not be permissible under German standard-terms law. In particular, liability for intent, gross negligence, and certain damages to life, body, or health cannot simply be excluded.

TARF Tweaks is therefore liable without limitation to the extent a limitation of liability is not legally permissible. In the case of a slightly negligent breach of material contractual obligations, liability is limited to the typically foreseeable damage. Otherwise, liability for damages caused by slight negligence is excluded to the extent legally permissible.

8. Macros, Games, and Bans

The user is solely responsible for reviewing the terms of use and rules of the games, platforms, anti-cheat systems, and competitions in which they intend to use TARF Tweaks software or features.

TARF Tweaks expressly advises against using macros or other features in games or on platforms where such use is prohibited by their rules or terms of service.

TARF Tweaks does not authorize, recommend, or endorse such use and expressly distances itself from it. This applies in particular to Fortnite: TARF Tweaks macros must not be used there where doing so would violate Epic Games' rules or Terms of Service.

TARF Tweaks does not guarantee that any feature is permitted by any given game or platform, and gives no assurance that use will not result in a game ban, account ban, suspension, competitive disqualification, or any other action by a third party.

Anyone who uses TARF Tweaks products in violation of a third party's rules does so at their own responsibility. Mandatory statutory liability of TARF Tweaks remains unaffected.

9. Updates and Changes

TARF Tweaks may update products, change features, fix bugs, or make security-related adjustments. Statutory obligations to provide required updates for digital products remain unaffected.

These Terms may be updated for future contracts. For existing contracts, changes apply only within the scope of the applicable statutory requirements.

10. Chargebacks and Fraud

Fraudulent or clearly unjustified chargebacks may be disputed with Stripe or the respective payment provider.

Where there is a reasonable suspicion of payment fraud, the associated license may be temporarily or permanently restricted to the extent legally permissible.

11. Copyright

Software, source code, designs, logos, graphics, texts, documentation, and other proprietary content of TARF Tweaks remain the intellectual property of leoworks or the respective rights holders.

Purchasing a product does not transfer any ownership rights in the source code or other intellectual property.

12. Final Provisions

German law applies. For consumers, mandatory consumer-protection provisions of the country of their habitual residence remain unaffected, to the extent applicable.

Should any provision of these Terms be invalid, the statutory provisions shall apply in its place. The remaining provisions shall generally remain unaffected.
