Withdrawal

Right of Withdrawal and No-Refund Policy.

Right of Withdrawal

Consumers generally have a statutory right of withdrawal of 14 days for distance contracts. For contracts concerning digital content not supplied on a physical data carrier, the withdrawal period generally begins upon conclusion of the contract.

TARF Tweaks products are digital products that, at the customer's request, can be delivered immediately after purchase.

Before immediate delivery, the customer must expressly consent to TARF Tweaks beginning performance of the contract before the withdrawal period has expired. At the same time, the customer must confirm their awareness that, by giving this consent, they lose their right of withdrawal once performance begins. TARF Tweaks then provides the legally required confirmation of the contract. Once these requirements are met and delivery has begun, the statutory right of withdrawal lapses.

Performance of the contract is deemed to begin at the moment TARF Tweaks provides the customer with the license key or access to the digital content, in particular by emailing the license key. Once this provision has begun, the statutory right of withdrawal lapses; no 14-day return period applies from that point onward.

Voluntary Refund Policy

TARF Tweaks generally does not provide voluntary refunds, returns, exchanges, or cancellations for digital products. This does not affect any statutory right of withdrawal that has not yet expired or any mandatory statutory rights relating to defective or non-delivered digital products.

For immediately supplied digital content, the statutory right of withdrawal can expire before the 14-day period ends if the customer expressly consented to TARF Tweaks beginning performance of the contract before the withdrawal period expired by immediately providing the content, the customer acknowledged the resulting loss of their right of withdrawal, TARF Tweaks began performance, and the required contract confirmation was provided.

Activation, redemption, device binding, and first use of a license key may still be logged via TARF Tweaks' own authentication and licensing system for licensing, security, support, and evidentiary purposes. This is not, however, the legal requirement for the statutory right of withdrawal to expire - only the conditions above are relevant to that.

In particular, no voluntary refund is available solely because of a change of mind, non-use, mistaken performance expectations, a change of hardware, or an accidentally selected product.

This policy does not remove any mandatory statutory claims arising from a product that is actually defective or was not delivered.

If the statutory right of withdrawal has not yet effectively lapsed, the withdrawal may be addressed to leoworks / TARF Tweaks, Bachstraße 96, 22083 Hamburg, Germany, email leoradtke@outlook.de, or submitted directly through the electronic withdrawal function on this page.

In addition, for distance contracts concluded via an online interface, an easily accessible electronic withdrawal function must be provided during a running withdrawal period. The German Civil Code (BGB) requires a function such as "withdraw from contract" along with a subsequent confirmation of the withdrawal. TARF Tweaks provides this function.

Checkout Consent

Directly before purchase, two separate, each required, checkboxes appear, neither pre-selected:

1. Terms & acknowledgement checkbox: "I accept the Terms & Conditions and acknowledge the Privacy Policy and Withdrawal Policy." Acknowledging the Privacy Policy is not a data-protection consent - only a confirmation of having taken note of the information.

2. Separate withdrawal consent: "I expressly consent to TARF Tweaks beginning performance of the contract before the 14-day withdrawal period has expired by immediately providing the digital content or license access. I acknowledge that my right of withdrawal expires once performance of the contract begins."

The time of both consents, their exact text and version, the order number, the customer's email address, the purchased product, the payment ID, and the time of digital delivery are stored together with the order.
